SCOTUS Victory for Arkansas Independent Pharmacists


On Thursday, the Supreme Court of the United States upheld an Arkansas statute designed to help family and independent pharmacies suffering at the hands of pharmacy benefit managers (or PBMs).


PBMs are the middlemen between the pharmacy and health insurers, and have acted in such a way to hurt local pharmacies across Arkansas and the Country.


In 2015, the Arkansas legislature passed Act 900 to require PBMs to reimburse pharmacies for their cost of pharmaceuticals filled for their patients. For years, PBMs had been forcing local pharmacies to lose money and often provided a reimbursement that was less than the pharmacy's cost for the drug. Of course, PBMs also own and operate big branded stores, and it's obvious they have always wanted to eliminate their small business competition.
